Lateral Extension of Sanitary Sewers

These are the forms and guidelines you will need to complete a Lateral Extension of MSD’s sewer system into a previously unserved area. You may click here (, 55K) to go to a general description of the process, or go immediately into the documents described on this page.

In order to expedite your lateral extension project, MSD employs just-in-time methods that require submission of logical groupings of documents needed to conduct a full review and approval, at each stage of the lateral extension process. MSD will not receive or store documents that are not part of a full submittal.

The Lateral Extension Just in Time Submittals (, 19K) diagram the notes the documents needed to constitute a full submittal. After Submittal 1 has been received, no further submittal may occur without approval of the previous submittal.

Upon delivery of each submittal, a preliminary screening will occur that will search for omissions of documents, and document information. If an omission exists, all documents will be returned to the submitter without further review.

The LE process begins with MSD’s determination that its system and/or treatment plant can accept the additional flow generated by your development. The review of a proposed development cannot be evaluated until this has occurred. Click for a Downstream Facilities Capacity Request form (, 61K), complete the form and return to MSD. After receiving your Request, MSD will make its determination and return the approved request to you

Your approved Request for Capacity is a part of your Application for Approval of Sanitary Sewer Project Design (, 57K) and must be included with the Application. Please be sure you have provided all the design information and documents required for a complete application. Your design will not be accepted and assigned a Plan Reviewer if the application is incomplete. In order to complete the application you will need the following forms, which can be downloaded from MSD’s website:

When you submit your Application to MSD you will simultaneously apply to the Kentucky Division of Water for their design approval. Click the link below to go to the KYDOW site and download their forms and instruction. Be sure to complete all steps required by the state, including payment of KYDOW fees, and submit the state forms to MSD along with your MSD application and attachments.

When your design has been approved by MSD and the Kentucky Division of Water, you will begin the next step in the LE process.. At that time you will receive notice of approval from MSD along with MSD’s Lateral Extension Charge Worksheet. This work sheet calculates all applicable fees due MSD for Capacity, Recaptures, and Pump Station Telemetry.

You will need to enter into a contract with MSD agreeing that, if you build the system according to MSD's specifications, MSD will extend the boundaries of the sewer district to include this new territory and will assume all maintenance responsibilities when the extension is officially accepted. This contract, that is required by state law, must be signed by the both the developer and the owner of the property. There are two versions of this contract available for use, depending if the Owner/Developer are the same or different entities. The Lateral Extension of Boundaries Agreement Instructions (, 25K) , must be followed to ensure the appropriate contract is used and that all information required by MSD, is provided in the appropriate manner and form.

The Agreement should be accompanied by several items that demonstrate that you are, indeed, ready to build. MSD cannot enter into the Agreement and issue a Notice to Proceed until we see that you have:

  • all permits required by local, state and federal agencies
  • all easements and rights-of-way required for use of private property and public roads
  • a Performance Bond (, 10K) with completed Accepted Bid Proposal (, 15K) form attached
  • a Maintenance Bond (, 8K) (if any pavement area is to be disturbed by project)
  • paid all amounts shown on Lateral Extension Charge Worksheet
  • certificates of insurance as required by Sewer Extension Special Provisions (, 134K)

When construction is complete, you will submit the following documents to close out the construction and allow MSD to take over operation of the system and/or facility:
